All Goods are sold or supplied by the Supplier "McCall Promotional Products" upon the following terms and conditions with reference to the Goods to which this contract relates.
Pennants purchased are custom made to your own Organisation or Club's specific requirements and therefore cannot be returned once purchased and delivered.
It is the customer's responsibility to approve the design prior to print and production. In the event you have not received exactly what was required, and this was an SPL error, we will replace your goods and/or refunds may be given at the discretion of the management.
An order form must be completed prior to payment being made. The order form is the contract to produce your goods and in some circumstances, we may have to fast track your order to meet your required deadline, prior to receiving payment.
The customer shall be responsible for applying the use of the goods to the required regulations to which the goods will be used.
Where goods go missing in transit, we the supplier, will initiate a claim with the courier and if found the courier is at fault, McCall Promotional Products will replace the said goods.
We, shall be entitled to make alterations to the materials, specifications, dimensions, designs, of the Goods, stock has depleted and new stock is slightly different from advertised. We may also have to alter a customer's design to ensure the printed image is of a high quality, any major changes a customer will be notified first. No alterations will have an impact on quality.
PDF proofs will be supplied prior to print run, these are for the purposes of a visual only and layout. Customer's are advised that we cannot produce an exact copy of the PDF proof. If in any doubt we can produce an actual proof Pennant if the costs for this proof are paid for in advance and agreed. Costs will be supplied for an actual proof and are not part of the quoted job costs. If an order has been placed using our order form and you wish to cancel the order once the design has been approved, we reserve the right to charge for the design work completed or if the production has already commenced. Charges for design work will be £60 minimum, production of goods charged at that stage of production.
The Customer shall be deemed to have accepted the Goods by signing the delivery note for the purposes of section 35 of the Sales of Goods Act 1979 as amended. The customer is responsible for checking their goods on delivery before signing the delivery note as received and accepted as in good condition.
In no circumstances shall the Supplier be liable to the Customer for any consequential loss or damage (whether for loss of profit or otherwise costs, expenses or other claims for consequential compensation) whatsoever and howsoever occasioned or arising.
This contract is subject to the laws of England and Wales and all disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales
An order form received and/or an approved PDF design is acceptance of our company terms and conditions
